Rideshare Accident Lawyer in Miami, Florida
Who pays after an Uber or Lyft crash depends on what the app was doing at that moment. We connect passengers, drivers and other motorists free with a Florida law firm that handles rideshare claims in Miami-Dade.
Uber and Lyft are part of how Miami moves: airport pickups, Brickell nights out, cruise-terminal runs to PortMiami. When a rideshare trip ends in a crash, who pays depends on what the driver’s app was doing at that exact moment. Florida Injury Team connects passengers, rideshare drivers and people hit by rideshare vehicles in Miami-Dade County with an independent Florida law firm that handles these claims. The consultation is free, and there are no fees unless the firm wins.
Where rideshare crashes happen in Miami-Dade
- Miami International Airport pickup zones and the connecting expressways, SR 112 and SR 836
- PortMiami cruise terminals on Dodge Island and the Port Boulevard bridge on embarkation days
- Brickell, Downtown and Wynwood at night, with constant curbside pickups and drop-offs in traffic
- The MacArthur and Julia Tuttle causeways to Miami Beach
- Coconut Grove, Coral Gables and the University of Miami area
- I-95 and the Palmetto, where a driver watching the app for the next request is a driver not watching the road
What Florida law says about Uber and Lyft insurance
Florida Statute 627.748 sets the insurance that transportation network companies must provide, and it changes with the status of the driver’s app:
- App off. The driver’s personal auto policy applies, and many personal policies exclude commercial use.
- App on, waiting for a request. At least $50,000 per person and $100,000 per accident in bodily injury coverage, and $25,000 in property damage coverage.
- Ride accepted, through drop-off. At least $1,000,000 in liability coverage for death, bodily injury and property damage.
Florida’s no-fault rules still come first: the initial $10,000 of medical bills generally runs through personal injury protection, and the rideshare policy must include PIP benefits while a trip is underway. Uber and Lyft drivers are independent contractors under Florida law, so the claim is built on these policies rather than on the company as an employer. The two-year deadline for negligence claims and the modified comparative negligence rule (recover only if 50% or less at fault) apply as in any Florida crash.
What to do in the first days after the crash
- Screenshot the trip in the app before anything else: the receipt, the driver’s name, the time, the route. That record establishes which insurance period applied.
- Report the crash inside the app so Uber or Lyft opens a file. Do not accept any settlement offered through that process before a lawyer reviews it.
- Get medical care. Ryder Trauma Center at Jackson Memorial Hospital is the Level I trauma center serving Miami-Dade, and treatment within 14 days protects PIP benefits.
- Get the crash report from Florida Highway Patrol Troop E, the Miami-Dade Sheriff’s Office or the City of Miami Police, depending on where it happened, via the FLHSMV Crash Portal.
- Collect witness names and look for video. Airport, port and downtown areas are heavily covered by cameras, and footage is overwritten quickly.
- If you were the driver, check whether your personal policy has a rideshare endorsement before you speak with any insurer.
Who can be held responsible
- The rideshare driver, for distraction, speeding or unsafe pickups
- The other driver, when a third vehicle caused the crash
- The rideshare company’s insurer, according to the app status at the moment of the crash
- The driver’s personal insurer, when a rideshare endorsement is in place
- The owner of the vehicle, when the driver was using someone else’s car
- Your own UM/UIM coverage, when the responsible driver’s limits are not enough
Where a Miami rideshare case is handled
Lawsuits from crashes in Miami-Dade are filed in the Eleventh Judicial Circuit at the Miami-Dade County Courthouse, 73 West Flagler Street. The firm obtains the driver’s trip logs and app status from the rideshare company through preservation letters and, if needed, subpoenas. Without that data, the insurer decides which period applied.
